Standard Trading Conditions

Terms of Service

Operational terms, carriage conditions, and liabilities governing global freight forwarding, warehousing, and customs brokerage.

Effective Date: October 18, 2020 • Last Updated: January 15, 2024 • Governing Authority: FIATA & International Maritime Standards
⚖️

Standard Trading Conditions

Operations adhere to recognized international forwarder liability rules and carrier Bill of Lading standards.

📋

Shipper Declarations

Clients are solely responsible for true product declarations, HS codes, invoice accuracy, and non-infringement.

📦

Pre-Carriage Settlements

Billable weight is verified upon warehouse intake; full invoice settlement is required before cargo release.

1 Application & Corporate Scope

These Terms of Service govern all freight forwarding bookings, customs brokerages, domestic consolidation runs, and marketplace prep services provided by CINA LOGISTICS (Shenzhen Bianjieda International Logistics Co., Ltd., established 2020).

By booking cargo, authorizing factory pickup, or signing shipping receipts with CINA LOGISTICS, the shipper, consignee, and cargo owner accept these conditions without exception.

2 Calculation of Freight & Billable Weight

Freight quotations are calculated based on verifiable chargeable metrics established at our Shenzhen or Yiwu consolidation facilities:

  • Ocean Freight (LCL/FCL): Billed by Total Cubic Meters (CBM) or container unit size (20GP, 40GP, 40HQ). 1 CBM is subject to ocean revenue ton standards where weight restrictions apply.
  • Air Freight & Courier: Billed by greater of actual gross weight or volumetric dimensional weight using standard IATA formulas:
    • Air Freight: (Length × Width × Height in cm) / 6000
    • Express Courier: (Length × Width × Height in cm) / 5000
  • Discrepancies: Final billable charges are calculated based on official warehouse scales and dimension scanning upon receipt.

3 Shipper Documentation & Customs Compliance

Clients warrant that all cargo information submitted via booking forms, invoices, and packing lists is accurate and strictly compliant:

  • Prohibited & Hazardous Goods: Shippers must formally declare batteries, powders, liquids, magnetics, or chemicals prior to dispatch. Weapons, illicit substances, and counterfeit trademark-infringing goods are strictly prohibited.
  • Customs Seizures: If destination or China Customs detains or fines cargo due to declared undervaluation, misdeclared HS codes, or trademark counterfeiting, all penalties, demurrage, and legal costs remain the sole responsibility of the client.

4 DDP Door-to-Door Delivery & Marketplace Docking

Under DDP (Delivered Duty Paid) service lines, CINA LOGISTICS oversees import clearance and duty payments on behalf of the customer:

  • Access & Delivery Docks: Consignees must ensure destination delivery locations have accessible loading docks or appropriate personnel to accept pallets/cartons. Secondary re-delivery attempts or residential lift-gate surcharges by local trucking carriers are billed at cost.
  • Amazon FBA & Walmart WFS: We deliver according to booked carrier dock appointments. CINA LOGISTICS is not liable for marketplace warehouse internal check-in processing backlogs once dock signature (POD) is acquired.

5 Free Warehousing, Consolidation & Lien

We provide up to 30 consecutive days of free warehouse storage in Shenzhen and Yiwu for multi-supplier order consolidation. Cargo held beyond 30 days without departure instructions may incur standard storage surcharges.

CINA LOGISTICS retains a general and specific legal lien over all cargo in its possession for any outstanding invoices, duties advanced, demurrage, or storage expenses.

6 Carrier Liability & Marine Cargo Insurance

CINA LOGISTICS acts as an authorized freight forwarder arranging carriage with contracted ocean steamship lines, airlines, and road transporters. Carrier liability is limited under international maritime conventions (e.g., Hague-Visby Rules for ocean, Warsaw/Montreal Convention for air cargo).

Clients are strongly advised to secure comprehensive All-Risk Marine Cargo Insurance through our operations desk to protect shipments against total vessel loss, rough sea damage, or general average contributions.

7 Payment Terms & Governing Law

Unless otherwise agreed under a formal credit agreement, all international freight settlements (via Bank of China corporate wire, TT, or payment portal) must be completed prior to customs release or destination dock handover.
